On January 3, 2017, OGE issued a notice in the Federal Register seeking comments from members of the public with expertise in trust law concerning the following question: Are there any circumstances under which an eligible income beneficiary of a discretionary trust might, in the absence of a vested remainder interest, be able to compel the trust to make a distribution or payment?
OGE has now extended the comment period for 45 days and will take into consideration all relevant expert input submitted by the public by April 20, 2017. You may access the original Federal Register issuance by clicking here: https://www.gpo.gov/fdsys/pkg/FR-2017-01-03/pdf/2016-31583.pdf.
